Madonna Concert Sparks Lawsuit Over Allegations of ‘Pornography Without Warning’

A critic of Madonna’s Celebration tour has filed a lawsuit against the singer, claiming that she performed “pornography without warning” and that he “was forced to watch topless women on stage simulating sex acts” throughout her concerts.

In the Los Angeles complaint that the Guardian viewed on Wednesday, the complainant, Justen Lipeles, made numerous claims. The case pertained to her performance at the Kia Forum in the city on March 7. Live Nation, the concert’s promoter, is also listed as a defendant alongside Madonna.

Lipeles spent $500 (£390) on four tickets, each of which said the show would begin at 8:30 p.m. Lipeles’ complaint claims that the performance started at 10 p.m., and that “Defendants did not provide any notice to the plaintiff that the concert will start at a later time.”

According to the complaint, Madonna insisted that the Kia Forum be unbearably hot and would not allow the air conditioning to turn on. Lipeles began sweating intensely and grew physically unwell as a consequence of the heat. When fans complained about the heat, Madonna irrationally instructed them to remove their garments.

“Furthermore, he saw Madonna lip-syncing throughout the concert. The plaintiff was coerced into seeing topless ladies execute simulated sex acts throughout the show. It was as if the plaintiff were seeing the making of a pornographic video. Lipeles’ claims include breach of contract, negligent misrepresentation, unfair competition, false advertising, and emotional distress.

It is said in the complaint that Madonna’s behavior was “intentional, extreme, and outrageous” and that she “did such actions with the intent to cause serious emotional distress or with reckless disregard of the probability of causing… serious emotional distress” about the second claim.

Lipeles is seeking compensatory damages, legal fees, and a return for the concert tickets. Madonna and Live Nation have not responded to the case. The Guardian has contacted representatives from each for comment. The action has similarities to another claim filed earlier in the Celebration tour run.

The New Yorkers Michael Fellows and Jonathan Hadden filed a lawsuit against Madonna in January, claiming that her December 13 performance at the Barclays Center in Brooklyn had a late start, but no pornography. After Madonna started the show at 10.30 pm, the couple said that they were “left stranded” after departing at 1 am and that the lateness interfered with the following day, when they “had to get up early to go to work.”

Live Nation and Madonna issued a joint statement, pledging to “defend this case vigorously” and claiming that a technical glitch was to blame for the delayed start.

Madonna previously faced lawsuits in 2019 and 2020 for being late during the Madame X tour, which were both rejected.

The celebration has been well-received by reviewers and audiences, despite Lipeles, Fellows, and Hadden’s dissatisfaction. Alexis Petridis of the Guardian said in a four-star review that her “strengths seem very strong indeed.”

With an estimated 1.6 million spectators, the tour came to a close after 80 concerts and $225 million in ticket sales during a free concert on Rio de Janeiro’s Copacabana beach.
